Faxpipe Terms And Conditions

I. I understand that use of FaxPipe's Internet Fax Service (Service) is subject to my complete agreement and adherence to the FaxPipe (Company) Terms and Conditions, Privacy Policy, and instructions given for the Service.
The Service includes, but is not limited to,

  1. Monthly or annual service fee (based on the package I have selected)
  2. One-time activation fee (non-refundable).

By indicating that I elect to use the Service, I apply for and subscribe to the Service on a month-to-month or annual basis. I understand that the following three (3) fees, which are subject to change, will be/have been assessed in connection with my subscription to the Service.

  1. One-time activation fee which is non-refundable.
  2. Monthly or annual service fee based on the service plan I have selected and associated overage charges.
  3. Monthly charge for each additional fax number I have added to my account.

II. Each FaxPipe plan contains an allotted number of fax pages to be utilized in a given billing cycle. Unless otherwise specified in a particular account offering, these included pages can be used in any combination of inbound and outbound faxing, totaling the chosen allotment.

Overage fees are charged for pages sent/received in excess of the monthly page allotment included in my selected plan.

If the transmission time of an inbound or outbound fax page exceeds sixty (60) seconds it may be charged a multi-page rate, resulting in possible overages. The Company agrees to utilize best efforts to adequately honor and supply quality service but make no warrant as to timeliness of Service delivery. Inbound or outbound Service pages left unused at the end of each monthly cycle will expire and do not carry over into the following monthly cycle. As these credits have no cash value, no refund will be issued for unused pages on your account. The Company may draw or transmit funds to its own order to pay for subscription to the Service and any charges that accrue from overage pages as consented herein. If my consent is not given, I understand that my account will be frozen until the account balance is made current.

III. I agree to pay all charges for my use of the Service in accordance with the pricing plan offered and agreed to upon registering for the Service. Pricing of each plan is subject to change and a one-time activation fee will be applied to the account's first billing cycle and is non-refundable. Each monthly or annual Service contract is automatically renewed upon receipt of payment or auto debit of authorized credit card. Payment is due before the first day of next monthly billing cycle. The billing cycle date is the monthly anniversary date of initial account activation. Payment is considered late on or after the first day of the next monthly billing cycle. If payment is considered late, a late fee of $10.00 will be assessed and Service may be temporarily discontinued. Reactivation of account may require an additional $10.00 for administrative data processing. Payment will be made using authorized credit cards kept on file on the account, or with mailed-in Cashier's Check or Money Order. I acknowledge that there are only two (2) methods of payment for the Service fees and the overage page costs, and that all financial transactions are given and shall be made in US Dollars:

  1. Automatic credit card debit to my FaxPipe account (VISA, MasterCard, Discover, and American Express).

    By selecting the "automatic credit card debit" option, I hereby agree to maintain sufficient funds or credit in my account(s) to cover each monthly billing charge. I hold responsibility for timely payment to the Company of all amounts due hereunder which accrue from my use of the Company's Service. I hereby authorize and request the Company and my financial institution (Bank) to establish an automatic credit card debit arrangement to pay for my subscription to the Company's Service in the amounts I have authorized. I hereby authorize and request the Company to obtain payment for such amounts as they become due by initiating and transmitting charges and debit entries to my designated accounts(s), and do hereby authorize and request Bank to accept and post said charges as transmitted by the Company. I further request the Company and the Bank to debit the amounts owed to my account without responsibility for the correctness thereof. If there is a change or error in my billing information, it is my responsibility to inform the Company. These changes include:

    1. new credit card number,
    2. new expiration date, and
    3. new billing address for credit card on file.

    If the credit card I have on file is canceled for any reason, I am responsible for notifying the Company of any changes.

  2. The Company's receipt of my Cashier's Check or Money Order.

    Cashier's Check or Money Orders must be sent to FaxPipe Internet Fax Services, 190 W. 800 N., Suite 202, Provo, UT 84601.

    In the event a check is returned upon presentation or a charge is denied upon transmittal by the Company for any reason, or if payment is stopped, the Company may immediately freeze or cancel my subscription to the Service. The Company may refuse my application for renewal of the subscription until full payment is received by the Company and at its own discretion. I agree to accept the debit entries so transmitted. If my Service is frozen or terminated for any reason, I agree to pay the $10.00 re-activation fee, in addition to any outstanding fees or usage charges, in order to re-activate Service.

IV. The Company or I may terminate Service, with or without cause, by written notice to the other. Any such notification by the Company to me shall be effective upon deposit in the mail, and by me to the Company upon receipt. Said notice shall serve as termination only as to those debit entries or charges transmitted by the Company after receipt of such notification and reasonable opportunity to act thereon. Thereafter, I will no longer be entitled to access the Service or assigned fax number. If my account selection requires an annual payment and I decide to terminate Service before the year has passed, I agree that I am entitled to a refund of any of the remaining unused monthly fees less any outstanding fees and an early termination fee of $10. V. I shall indemnify and hold the Company harmless from any and all damage and liability which may arise from its transmittal and presentation of a charge to my account(s) and for its reasonable inability to timely or adequately honor my subscription to the Company's Service. I shall indemnify and hold the Company harmless from any and all damage to me and/or my personal business which may arise from malfunction of electronic equipment, Acts of God, or suspension or termination of my Service for lack of payment or abuse on my part. Company's liability to customer in any event is limited to a refund of applicable Service fees. I agree to comply with the law and will not use Company's system for illegal purposes. I shall indemnify the Company for any cause of action which may be caused from my misuse of the Company's Service. FaxPipe reserves the right to refuse Service to anyone at any time for any reason.

VI. I have read, understood, and agree to comply with and be bound by the Terms and Conditions, the receipt of which I hereby acknowledge, and which terms and conditions are incorporated herein by reference. I also understand and agree that the terms, rates, costs, and fees are subject to change upon 15 days’ notice to me, either written or posting such changes on the Company's website.
