Comprehensive Terms and Conditions of Service
Effective Date: January 15, 2026
These Terms and Conditions of Service (collectively, the “Terms”) constitute a legally binding agreement between you (“Customer,” “you,” or “your”) and FaxPipe Internet Fax Services (“FaxPipe,” “Company,” “we,” “us,” or “our”) governing your access to and use of FaxPipe’s internet-based fax transmission services and any related features, software, websites, applications, or support services (collectively, the “Service”) and supersedes all prior oral and written communications and agreements between you and the Company regarding the subject matter of this agreement.
By registering for, accessing, or using the Service in any manner, including but not limited to creating an account, submitting payment information, transmitting or receiving faxes, or otherwise utilizing any functionality of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any policies, guidelines, or instructions referenced herein or provided in connection with the Service, all of which are incorporated by reference.
If you do not agree to these Terms, you must not access or use the Service.
1. Description and Scope of the Service
FaxPipe provides an internet-based fax transmission platform that enables users to send and receive fax communications electronically using assigned fax numbers and related features pursuant to the service plan selected by the Customer.
The Service may include, without limitation:
- Inbound and outbound fax transmission
- Assignment and management of fax numbers
- Monthly or annual page allotments
- Customer support services
FaxPipe reserves the right, in its sole discretion, to modify, update, suspend, limit, or discontinue any aspect of the Service, including features, functionality, or availability, provided that such changes do not materially deprive you of the core functionality of the Service during an active, paid period.
2. Eligibility and Authority
By using the Service, you represent and warrant that:
- You are at least eighteen (18) years of age
- You have the legal authority to enter into these Terms and to be financially responsible for your use of the Services (as well as for use of your account by others, including, without limitation, minors living with you)
- If using the Service on behalf of a business or other legal entity, you have authority to bind that entity, and all references to “you” shall apply to such entity
3. Services, Fees, and Billing
3.1 Service Term
The Service is offered on a month-to-month or annual basis, as selected during registration. Services automatically renew at the end of each billing cycle unless terminated in accordance with these Terms. The billing cycle date is the monthly anniversary date of initial account activation. Payment is considered late on or after the first day of the next monthly billing cycle.
3.2 Automatic Renewal and Cancellation Acknowledgment
BY AGREEING TO USE THE SERVICE, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR SERVICE PLAN WILL AUTOMATICALLY RENEW AT THE END OF EACH BILLING CYCLE UNLESS YOU CANCEL PRIOR TO RENEWAL IN ACCORDANCE WITH THESE TERMS.
You may cancel your plan at any time prior to the renewal date through the account management interface or by providing written notice to FaxPipe as set forth herein. Cancellation will be effective at the end of the then-current billing period unless otherwise required by applicable law.
FaxPipe does not provide refunds for partial billing periods except as expressly stated in these Terms or as required by applicable law.
3.3 Fees and Charges
You agree to pay all fees associated with your selected service plan, which may include:
- A one-time, non-refundable activation fee
- Recurring monthly or annual service fees
- Overage charges for fax pages exceeding the allotted number included in your plan
- Fees for additional fax numbers or optional services
All fees are charged in United States Dollars and are exclusive of any applicable taxes, which you are responsible for paying.
3.4 Page Allotments and Overage Billing
Each service plan includes a specified number of fax pages per billing cycle. Pages may be used for inbound and outbound transmissions in any combination unless otherwise stated.
Unused pages:
- Expire at the end of the applicable billing cycle
- Do not roll over
- Have no cash or refund value
Fax transmissions that exceed sixty (60) seconds per page may be billed as multiple pages, which may result in overage charges. FaxPipe does not guarantee transmission speed, duration, or page calculation consistency due to factors outside its control such as but not limited to someone answering the call or transmission is interrupted before completion.
4. Payment Authorization and Collection
By providing payment information, you authorize FaxPipe to charge all applicable fees to your designated payment method, including recurring automatic charges. Payments will be made using authorized credit cards kept on file on the account, or with mailed-in Personal, Business or Cashier's Check or Money Order.
You agree to:
- Maintain valid and current payment information
- Ensure sufficient funds or credit availability
- Promptly update billing information if it changes
- Promptly mailing Cashier’s Check or Money Order and must be sent to FaxPipe Internet Fax Services, 190 W. 800 N., Suite 202, Provo, UT 84601.
FaxPipe reserves the right to apply all payments received from you, including partial payments, credits, refunds, chargeback reversals, or other amounts applied to your account, may be applied by FaxPipe, in its sole discretion, to the oldest outstanding invoice, fee, charge, or balance owed on your account, regardless of the billing period, service period, or invoice designation referenced by you at the time of payment.
FaxPipe’s application of payments shall not constitute a waiver of any rights, remedies, or claims with respect to any remaining balances, disputed amounts, or unpaid charges.
Acceptance of any payment by FaxPipe, whether marked as “paid in full,” “final payment,” or similar designation, shall not constitute an accord and satisfaction or release of any outstanding obligations unless expressly agreed to in writing by FaxPipe.
If a payment is declined, reversed, disputed, or stopped for any reason:
- FaxPipe may immediately suspend or terminate Service
- Outstanding balances may accrue a late fee of 1% per month or $1.00, whichever is greater
- A $10 administrative reactivation fee may be required
- A $20 fee will be accessed for each returned check.
FaxPipe shall not be responsible for overdraft fees, chargeback penalties, or other bank-imposed costs.
5. Suspension, Termination, and Account Closure
5.1 Termination Rights
Either party may terminate the Service at any time, with or without cause, upon written notice. Written notice is to be by email to [email protected] or mailed to the address set forth herein in section 21.
5.2 Effect of Termination
Upon termination or suspension:
- Your access to the Service will cease
- Assigned fax numbers will be deactivated and may be reassigned or released
- All outstanding fees become immediately due and payable including all late fees
Annual plans terminated prior to expiration are eligible for a refund of unused monthly service fees, less outstanding balances and a $10 early termination fee. Refunds are to be issued within 30 days of termination through your original payment method or a check mailed to the address on record.
FaxPipe shall not be liable for any data loss, business interruption, or damages resulting from suspension or termination.
6. Acceptable Use and Legal Compliance
You agree that you are solely responsible for:
- All content transmitted using the Service
- Determining the legality and compliance of your use of the Service
- Compliance with all applicable laws and regulations, including but not limited to privacy, data protection, telecommunications, healthcare, financial, and consumer protection laws
You shall not use the Service to transmit unlawful, fraudulent, infringing, abusive, or harmful content.
FaxPipe does not monitor, review, verify, or control transmitted content and acts solely as a passive conduit. However, FaxPipe reserves the right to take any action with respect to the Services that the Company deems necessary or appropriate in its sole discretion, if the Company believes you or your information may create liability for the Company, compromise or disrupt the Services for you or other customers, or cause the Company to lose (in whole or in part) the services of the Company’s ISPs or other suppliers. Your use of the Services is subject to all applicable local, state, national, and international laws and regulations.
7. No Agency, Fiduciary, or Custodial Relationship
Nothing in these Terms or in the provision of the Service shall be deemed to create any agency, partnership, joint venture, fiduciary, confidential, or special relationship between FaxPipe and you. FaxPipe does not act as your agent, representative, data custodian, records manager, or advisor, and does not assume any duties beyond those expressly set forth in these Terms.
You acknowledge and agree that FaxPipe has no responsibility to supervise, manage, preserve, verify, validate, or ensure the legal sufficiency, accuracy, compliance, or admissibility of any fax transmission or related information.
8. Fax Storage and Retention Limitations
FaxPipe does not provide document storage, archival, backup, or record-retention services of any kind. The Service is intended solely as a transmission conduit for fax communications. Any temporary storage of fax transmissions by FaxPipe is incidental to the operation of the Service and is provided solely for purposes of facilitating transmission.
Fax transmissions, including inbound and outbound faxes and any associated metadata, are not intended to be stored by FaxPipe and are typically automatically deleted from FaxPipe’s systems within twenty-four (24) hours after transmission or attempted transmission. Any deviation from this standard must be in a separate, written agreement signed by FaxPipe. FaxPipe makes no representation, warranty, or guarantee regarding the availability, retrievability, integrity, or duration of any fax data beyond this limited and temporary period.
8.1 Customer Responsibility for Records
You acknowledge and agree that you are solely responsible for:
- Downloading, copying, exporting, or otherwise retaining any fax transmissions you wish to preserve
- Maintaining your own backups, archives, and records
- Ensuring compliance with any applicable legal, regulatory, contractual, or industry-specific record retention requirements, including but not limited to healthcare, financial, legal, or governmental obligations
FaxPipe shall have no obligation to retain, retrieve, reproduce, or provide copies of any fax transmissions at any time, whether before or after deletion.
8.2 No Liability for Deletion or Data Loss
You expressly acknowledge and agree that FaxPipe shall not be liable for any loss, deletion, corruption, unavailability, or failure to retain fax transmissions or related data, regardless of cause, including system processes, maintenance, service interruptions, or termination of your account.
You further agree that fax transmission records maintained temporarily by FaxPipe, if any, shall not be relied upon as an official record, proof of transmission, or evidence of delivery, receipt, or legal sufficiency.
9. FaxPipe Service Telephone Numbers
Customers who sign up for certain FaxPipe Services will be permitted to use certain FaxPipe telephone numbers specifically identified for use by Customer in connection with our Services. In such cases, FaxPipe, not the Customer, is the end-user subscriber for such Service Numbers, and the Customer shall not obtain or assume any right or interest in any FaxPipe Service Number. You may port any FaxPipe Service Numbers to other service providers, provided that your account is paid current (See section 4: Payment Authorization and Collection) and in good standing and FaxPipe’s authorization for the port is obtained in advance. FaxPipe, as the end-user subscriber for all Service Numbers, has the right, in its sole discretion, to determine the manner in which Service Numbers may be used. FaxPipe reserves the right to cancel, change or modify any FaxPipe Service Number at its sole discretion.
9.1 Customer Ported Telephone Numbers
Should you elect to port a telephone number owned by you to the FaxPipe Services, then you shall remain the end-user subscriber for that telephone number and shall have the right to port that number out to another service provider, if you should choose to do so, FaxPipe’s authorization for the port is obtained in advance, and as long as your account is paid current.
10. No Assumption of Regulatory Obligations
FaxPipe does not assume and expressly disclaims any obligation to comply on your behalf with laws or regulations applicable to your industry, including but not limited to healthcare, financial services, legal, or governmental recordkeeping or transmission requirements. Use of the Service does not constitute a representation that the Service complies with any specific regulatory framework.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS AND THE USE OF THE SERVICE IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAXPIPE EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY, RELIABILITY, OR COMPLETENESS OF TRANSMISSIONS
- UNINTERRUPTED, SECURE, OR ERROR-FREE OPERATION
- GUARANTEED DELIVERY, RECEIPT, OR LEGAL EFFECTIVENESS OF ANY FAX
12. Transmission Security Disclaimer
You acknowledge that fax and internet-based communications involve inherent security risks. FaxPipe does not represent or warrant that fax transmissions or related data will be secure, confidential, encrypted, immune from interception, unauthorized access, disclosure, alteration, delay, or loss, or free from malicious code or cyber intrusion.
You assume all risks associated with the transmission of sensitive, confidential, or regulated information using the Service.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
IN NO EVENT SHALL FAXPIPE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, LOSS OF GOODWILL, OR SUBSTITUTE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
FAXPIPE’S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES PAID BY YOU TO FAXPIPE DURING THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
14. Indemnification
You agree to defend, indemnify, and hold harmless FaxPipe and its officers, directors, employees, contractors, and agents from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use or misuse of the Service
- Content transmitted through the Service
- Your violation of these Terms or applicable law by you or any other person using your account
- Any infringement of intellectual property or other rights of any third parties
This indemnification obligation survives termination.
15. Force Majeure
FaxPipe shall not be liable for failure or delay in performance caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, internet or telecommunications outages, cyber incidents, labor disputes, governmental actions, or failures of third-party service providers.
16. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to conflict-of-law principles.
Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively by binding arbitration conducted in Utah County, Utah, under the rules of the American Arbitration Association.
TO THE EXTENT PERMITTED BY LAW, YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE PROCEEDING.
16.1 Arbitration Procedures; Costs; Survival; Severability
The arbitration obligation set forth herein shall survive termination of these Terms and your use of the Service.
Arbitration fees and costs shall be allocated in accordance with the applicable rules of the American Arbitration Association, subject to any limitations imposed by applicable consumer protection laws, and the arbitrator shall have authority to award any relief permitted by law, subject to the limitations set forth in these Terms.
If the class action waiver is found unenforceable with respect to a particular claim, such claim shall nevertheless be resolved by arbitration on an individual basis, to the fullest extent permitted by law.
If any portion of this arbitration provision is deemed unenforceable, the remaining portions shall remain in full force and effect.
17. Assignment
You may not assign or transfer these Terms without prior written consent from FaxPipe. FaxPipe may freely assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
18. Modifications to Terms
FaxPipe reserves the right to modify these Terms upon at least fifteen (15) days prior notice, which may be provided via email, account notification, statement or invoice, or website posting. Continued use of the Service fifteen (15) days after such notice constitutes acceptance of the revised Terms.
19. Survival
The following provisions survive termination:
Fees and Payment Obligations, Acceptable Use, Fax Storage, Data Retention, Deletion Policy, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law and Arbitration, and Miscellaneous.
20. Entire Agreement; Severability
These Terms constitute the entire agreement between the parties regarding the Service and supersede all prior agreements or understandings. If any provision is held unenforceable, the remaining provisions shall remain in full force and effect.
